Welcome to Duck Stop Pro.

These Terms of Use (“Terms”) govern your access to and use of the Duck Stop Pro mobile application, websites, loyalty program, transportation services, rewards platform, and related services (collectively, the “Services”) operated by Duck Stop Travel Center (“Duck Stop,” “Company,” “we,” “our,” or “us”).

By downloading, installing, creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. About Duck Stop Pro

Duck Stop Pro is a customer engagement platform that may provide access to:

■Loyalty rewards programs

■Digital coupons and promotions

■Purchase history

■Receipt submission programs

■Mobile ordering services

■Transportation and pickup services

■Store information

■Location-based services

■SMS communications

■Push notifications

■Customer account management

■Future products and services offered by Duck Stop

Features may vary by location and may change without notice.

2. Eligibility

To use the Services you must:

■Be at least thirteen (13) years old;

■Be legally capable of entering into binding agreements;

■Provide accurate registration information;

■Comply with these Terms and all applicable laws.

Users under the age of majority must have parental or guardian consent.

3. Account Registration

Certain Services require account registration.

You agree to:

■Provide accurate information;

■Keep account information current;

■Maintain the confidentiality of your credentials;

■Notify Duck Stop of unauthorized account activity.

You are responsible for all activity occurring under your account.

Duck Stop reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Loyalty Program Participation

Participation in loyalty programs is voluntary.

The Services may allow users to:

■Redeem rewards

■Access digital coupons

■Participate in promotional campaigns

Points, rewards, offers, and coupons:

■Have no cash value unless expressly stated;

■Are not transferable;

■May expire;

■May be modified or discontinued at any time.

5. Mobile Ordering and Purchases

Certain Services may permit users to place orders, make purchases, or redeem rewards.

Availability of products, pricing, promotions, and inventory is not guaranteed.

Duck Stop reserves the right to:

■Refuse transactions;

■Correct pricing errors;

■Limit quantities;

■Cancel orders due to operational, inventory, technical, or security issues.

6. Transportation and Pickup Services

Duck Stop Pro may allow users to request transportation, pickup, shuttle, or related services offered by Duck Stop Travel Center.

Service availability may vary based upon:

■Operating hours

■Staffing availability

■Service area restrictions

■Traffic conditions

■Weather conditions

■Vehicle availability

■Safety considerations

Pickup times displayed within the Services are estimates only and are not guaranteed.

Duck Stop reserves the right to decline, cancel, postpone, or terminate transportation services when reasonably necessary for safety, operational, legal, or business reasons.

7. Location Services

Certain features require access to your location.

By enabling location permissions, you authorize Duck Stop to collect, process, and use location information to:

■Locate nearby locations

■Provide location-based offers

■Facilitate transportation services

■Coordinate pickups

■Improve service quality

■Enhance safety and security

Where authorized by you, location information may be collected while the application is operating in the foreground and while operating in the background.

Location permissions may be disabled through your device settings; however, certain Services may no longer function properly.

8. Communications

By creating an account, you consent to receive communications related to your use of the Services, including:

■Account notifications

■Security alerts

■Transaction confirmations

■Reward notifications

■Service updates

■Transportation updates

■Customer support communications

Where permitted by law and subject to your consent preferences, Duck Stop may also send promotional communications through:

■Email

■SMS

■Push notifications

■In-app messaging

9. User Conduct

You agree not to:

■Violate applicable laws;

■Attempt unauthorized access to systems;

■Interfere with the Services;

■Circumvent security measures;

■Submit fraudulent information;

■Abuse promotions or rewards programs;

■Use automated systems to access the Services;

■Engage in activity that harms Duck Stop, its employees, customers, or systems.

Duck Stop may investigate violations and take appropriate action.

10. Intellectual Property

The Services and all related content are owned by Duck Stop or its licensors and are protected by applicable intellectual property laws.

This includes:

■Software

■Logos

■Trademarks

■Graphics

■Text

■Images

■Videos

■Databases

■Marketing materials

No ownership rights are granted through use of the Services.

11. Third-Party Services

The Services may integrate with third-party technology providers, payment processors, analytics providers, mapping providers, communications providers, and other vendors.

Duck Stop is not responsible for the availability, security, content, or practices of third-party services.

Your use of third-party services may be governed by separate agreements.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, DUCK STOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

■MERCHANTABILITY;

■FITNESS FOR A PARTICULAR PURPOSE;

■NON-INFRINGEMENT;

■ACCURACY;

■RELIABILITY;

■CONTINUOUS AVAILABILITY.

Duck Stop does not guarantee uninterrupted operation of the Services.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCK STOP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.

DUCK STOP’S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

■$100 USD; OR

■THE AMOUNT PAID BY YOU TO DUCK STOP THROUGH THE SERVICES DURING THE PRECEDING TWELVE MONTHS.

14. Indemnification

You agree to defend, indemnify, and hold harmless Duck Stop, its affiliates, officers, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising from:

■Your use of the Services;

■Your violation of these Terms;

■Your violation of applicable law;

■Your infringement of third-party rights.

15. Suspension and Termination

Duck Stop may suspend, restrict, or terminate access to the Services at any time if:

■These Terms are violated;

■Fraudulent activity is suspected;

■Security concerns arise;

■Required by law;

■Necessary to protect customers, employees, or business operations.

16. Changes to Services

Duck Stop may modify, suspend, discontinue, or replace any feature or portion of the Services at any time without liability.

17. Changes to Terms

Duck Stop may revise these Terms from time to time.

Updated Terms become effective upon posting within the Services or website.

Continued use of the Services constitutes acceptance of revised Terms.

18. Governing Law

These Terms shall be governed by the laws of the State of Illinois.

Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
