SMS & TEXT MESSAGING TERMS

These SMS & Text Messaging Terms (“SMS Terms”) govern participation in text messaging programs offered by Duck Stop Travel Center (“Duck Stop,” “we,” “our,” or “us”) through the Duck Stop Pro application, website, rewards platform, transportation services, and related offerings (collectively, the “Services”).

By providing your mobile phone number and opting into SMS communications, you agree to these SMS Terms.

1. Consent to Receive Text Messages

By voluntarily providing your mobile phone number and opting into text messaging communications, you expressly consent to receive recurring automated and non-automated text messages from Duck Stop.

Transportation and pickup updates

Consent to receive text messages is not a condition of purchasing goods or services.

2. Transportation and Pickup Notifications

If you request transportation, pickup, or related services through Duck Stop Pro, you consent to receive communications relating to those services.

These communications may include:

Ride request confirmations
Driver assignment notifications
Driver arrival notifications
Pickup status updates
Service delays
Service cancellations
Customer support communications

These messages may be operational in nature and may be sent regardless of marketing communication preferences.

3. Message Frequency

Message frequency will vary depending on:

Account activity
Rewards participation
Transportation requests
Promotional campaigns
Security requirements
Customer support interactions

Duck Stop does not guarantee any minimum or maximum number of messages.

4. Message and Data Rates

Message and data rates may apply.

Charges are determined by your wireless carrier and mobile service plan.

Duck Stop is not responsible for any carrier fees or charges associated with text messaging.

5. Opting Out

You may opt out of promotional text messages at any time by:

Replying STOP to any promotional text message;
Updating communication preferences within Duck Stop Pro;
Contacting Duck Stop customer support.

After opting out, you may receive a final confirmation message.

Please allow reasonable time for processing.

6. Operational Messages

Even if you opt out of marketing communications, Duck Stop may continue sending messages necessary to:

Secure your account;
Verify your identity;
Complete transactions;
Administer rewards programs;
Coordinate transportation services;
Provide customer support;
Comply with legal obligations.

These messages are considered service-related communications.

8. Mobile Number Responsibilities

You represent and warrant that:

Duck Stop is not responsible for messages sent to reassigned, recycled, or incorrect phone numbers.

9. Carrier Availability

SMS services depend upon wireless carrier networks and device compatibility.

Duck Stop does not guarantee:

Message delivery;
Message timing;
Carrier availability;
Continuous service.

Participating carriers are not liable for delayed or undelivered messages.

10. Electronic Communications Consent

By participating in Duck Stop’s SMS programs, you agree that text messages and electronic communications satisfy any legal requirement that communications be provided in writing.

11. Prohibited Conduct

You may not:

Enroll phone numbers belonging to others without authorization;
Use automated systems to create fraudulent enrollments;
Attempt to interfere with messaging systems;
Abuse promotional messaging programs;
Engage in fraudulent activity relating to communications services.

12. Privacy

Information collected through SMS programs is governed by the Duck Stop Pro Privacy Policy.

Duck Stop may use communication-related information to:

Deliver requested messages;
Administer rewards programs;
Coordinate transportation services;
Improve customer experiences;
Comply with legal obligations;
Maintain security and fraud prevention systems.

Duck Stop does not sell mobile phone numbers to third parties.

13. Changes to SMS Terms

Duck Stop may modify these SMS Terms at any time.

Changes become effective when posted within the Services or on our website.

Continued participation in SMS programs constitutes acceptance of revised SMS Terms.

14. Limitation of Liability

To the fullest extent permitted by law, Duck Stop shall not be liable for:

Delayed messages;
Undelivered messages;
Carrier outages;
Wireless network failures;
Technical interruptions;
Messaging delays outside of Duck Stop’s reasonable control.
